ST FRANCIS CHURCH HIRING AGREEMENT

The Hirer agrees to observe and perform the terms and conditions contained or referred to in the attached Standard Conditions for Hire and Rules and Information for use of St Francis Church and Hall. The Church permits the Hirer to use that part or parts of the Premises booked for the “Purpose of Hiring” and for the times described above, subject to the Hiring Fee and Deposit being paid and the Standard Conditions for Hire being observed and performed. References in “….” are definitions. The Hirer understands that the Church may need to access the Premises during the Hire for the purposes of church business but the Church will endeavour not to interfere with the Hiring.  The Hirer is required to ensure that children and adults who may be vulnerable are protected at all times, by taking reasonable steps to prevent injury, illness, loss or damage occurring, and that you carry full liability insurance for this.

“The Premises” means that part of St Francis Church and/or Church Hall booked for an activity with the right, together with use of such part, to use (a) the kitchen to prepare drinks, (b) the toilets and (c) common parts walked through to access the part booked.

Use of Premises – The Hirer shall use the Premises only for the Purpose of Hiring and not for any unlawful purpose.

Payment of Deposit Hire Fees and Additional Charges – The Deposit, payable on signing the Hiring Agreement shall only be refundable to the Hirer in advance if the Church cancels the booking or the Hirer cancels the booking by notice at least one week before the time of the booking in question. The Hirer shall pay the Hiring Fee including payment for any Additional Facilities in full before the Hiring. Failing receipt of any Hiring Fees, any provisional bookings shall be cancelled. The deposit will be refunded within one week after the hire date provided that the Hall has been left clean and tidy and no damage has been caused to the Premises, its fixtures and fittings or other property not belonging to the Hirer at the Church.

Force-Majeure – The Church shall not be liable for any loss or damage caused by any interruption in or failure to provide any part of the Premises or Additional Facilities due to causes beyond the reasonable control of the Church.

Damage and Clean up – Accidents can happen and if there is any damage to the Premises its fixtures or fittings or other property not belonging to the Hirer at the premises the Hirer shall report it to the Church who can get it repaired or replaced. The Hirer is responsible for the cost of making good such damage and for any cleaning necessary at the Church if the Premises are not left in a clean and tidy condition. The Hirer understands that this may involve bringing in commercial cleaners at the Hirer’s expense. The cost of such damage and such cleaning shall be deducted from the deposit and if the cost exceeds the ` deposit then the Church shall invoice the Hirer for the excess and the Hirer shall pay the excess to the Church.

GENERAL CONDITIONS:

(1) The Hirer shall:

a: Not permit more than the maximum number of people, notified to him by the Church, to be in any room at any time.

  1. Leave the Premises in a clean and tidy condition with everything put away, undamaged and free from rubbish and any items brought into the Premises and leave the Premises properly locked and secured, returning the keys to the Church’s Representative, close all opened windows and turn off all gas appliances, electric heaters and lights, except for the emergency lighting.
  2. Ensure that any electrical appliances brought by him into the Premises shall be safe, in good working order, and used in a safe manner in accordance with the Electricity at Work Regulations 1989.
  3. Ensure that he is aware of the location and use of fire equipment in the Premises, the escape routes, methods of operating escape door fastenings, that all fire exits are unlocked, that all escape routes are free of obstruction and can be safety used and that any fire doors are not wedged open.
  4. Be responsible for proper supervision, quiet and orderly conduct, protection of the Premises and contents from damage and that no nuisance is caused to other occupiers of the Premises or any adjoining premises.
  5. Ensure no bolts, nails, tacks, screws, pins, hooks, strong adhesive or other such like objects are used in or on any part of the Premises and no decorations are put up near light fittings or heaters.
  6. Not allow smoking, the consumption of drugs or any other illegal substances on the Premises.
  7. Not trade or allow trading to take place from the Premises during the Hire Period, unless agreed in writing by the Church.
  8. Not permit posters, advertisements or notices to be displayed on the Premises without the consent of the Church.
  9. Not sub-hire or assign use of the Premise to any third party.
  10. Be responsible for acquiring any necessary licence for music, dancing or other licensable activity falling within the Hiring and shall provide a copy to the Church before such licensable activity takes place.
  11. Not permit animals, other than guide dogs, to be brought on to the Premises
  12. Take all reasonable steps to ensure no personal injury or damage is caused during the Hiring.
  13. Use the Premises and fixtures, fittings and other property on the Premises at the Hirer’s own risk o. Comply with the Rules and Information for use of St Francis Church and Hall supplied to the Hirer.

(13a) The Church does not accept any responsibility for any property left by the Hirer on the Premises

(13b) All waste from the use of the hall must be collected by the hirer/representative (s) respectfully and failure to do so will forfeit your deposit to cover the cost of the waste management.

Hiring Agreement – This Hiring Agreement constitutes only a licence to use the Premises or part of the Premises. The Hirer agrees that no tenancy is created between the Church and Hirer by this Hiring Agreement.

Safeguarding Children and Adults who may be Vulnerable – The Hirer agrees to abide by Policy and Procedures of St Francis Church relating to the Safeguarding of Children and Adults who may be vulnerable, and will show evidence to the booking secretary if required. The Hirer understands the hiring agreement may be terminated in the event of failing to comply with these procedures

Please note that your confirmed booking does not include any additional charges for the use of the Lighthouse Kitchen. This means that the use of ovens in the Lighthouse Kitchen for meal preparation, as well as the use of crockery and cutlery, will incur extra costs.
